Something changed in the first half of 2026. PECR fines rose from a £500,000 cap to £17.5 million or 4% of global turnover - whichever is higher.

Directors can now be held personally liable for up to £500,000. At the same time, the FCA has stopped asking “have you implemented Consumer Duty?” and started asking “can you prove it?” - and after reviewing 180 board reports in 2024, it published exactly what a weak report looks like: no genuine board engagement, no evidence vulnerable customers got equivalent outcomes.

Underneath both sits SM&CR: accountability that reaches the named individual, not just the firm. If you carry that risk personally, a 2% call sample was never a strong position. Now it's an exposed one.
